In a landmark judgment in guardianship laws, Uttarakhand HC made grandparents equally responsible for custody of children whose parents are engaged in matrimonial dispute.”It is necessary to direct (family courts) that custody of a child should go to parents as well as grandparents so that the child’s emotional development is not affected,” ruled a division bench of Chief Justice Ritu Bahri and Justice Rakesh Thapliyal.
